Frequently Asked Questions Regarding Criminal Law

1.  Should I hire an attorney for a simple speeding or traffic ticket?

Yes. Sometimes a speeding or traffic ticket can have greater implications than a person realizes. Factors such as your prior driving record, rate of speed, and whether or not you were involved in an accident can cause a ticket to potentially have consequences which may affect your ability to drive. An attorney may be able to negotiate a plea bargain with the prosecution that can result in no points being added to your license, amended charges, or even dismissal of charges in certain circumstances. 2.  How much do you charge for a traffic or criminal cases?

 

We strive to provide you with individualized cost-effective service, we ask that you set up an initial consultation with us in order to discuss cost. During your 30 minute consultation, we can discuss all of your legal options and settle on a fair price. Often times, we are able to offer flat rate fees for our services. In other cases, we will work with you to establish a fair retainer amount. A retainer is a deposit, or advance-payment from you, which we deposit into a separate trust account (known as an IOTA or IOLTA) and hold for you pending case completion. We then work hourly and use the retainer funds to pay ourselves, all while providing you monthly statements detailing our work.  At the end of representation, all unused funds are returned to you. 

 

We may, in some cases, later ask for an additional retainer if the original sum deposited turns out to be inadequate or if additional services, such as a jury trial, are requested. We don't have a standard set retainer rate. The amount of the retainer fee that we will request differs from case to case depending upon things like the anticipated complexity of the case, the amount of responsibility involved, the client's ability to pay, and the amount of work that must be done at the outset, among other factors.

4.  What are my basic rights when interacting with law enforcement?

As a United States citizen, you have certain constitutional rights you are entitled to exercise when dealing with law enforcement. Among them are the right to remain silent and the right to an attorney. If you wish to exercise these rights, you should clearly state your intent to the officer in a way which cannot be misinterpreted. One possible way to say this is "I am invoking my right to silence and I want an attorney present before speaking to you further." Most importantly, if you do invoke these rights then you should cease all communication until you have a chance to speak with your attorney. Many people invoke these rights but then implicitly waive them by continuing to speak with law enforcement afterward.

 

You also have the right to be free of unreasonable searches and seizures.  What constitutes a reasonable search depends on many factors which we can go over with you in a free consult. Note that just because you refuse a search of yourself or belongings it does not prevent the officer from carrying out a search, but it may help preserve your rights in court. It's always best to speak to an attorney if you are unsure of your rights.

5.  What should I do if I believe my rights have been violated?

First of all, stay calm. Write down everything you remember as soon as possible, including details of the interaction, officer badge numbers and what department the officers are from. Gather contact information from any witnesses and take pictures of the scene, if it is safe to do so. If you're injured, seek medical attention right away and document your injuries. Contact a lawyer right away to discuss your case. 

6.  Will my criminal or traffic charges affect my immigration status?

Sometimes, authorities may investigate your immigration status if you have interactions with law enforcement, and certain crimes can have serious consequences to your immigration status.  Many factors must be taken into consideration to properly advise you of the effects of a criminal or traffic charge on your immigration status. However, traffic charges are much less likely to cause issue for you if they are minor traffic violations. Generally, ICE and immigration authorities are more concerned with major crimes that pose a danger to public safety or indicate "moral turpitude." Crimes of moral turpitude is a rather broad concept coving crimes ranging from violent crimes to crimes of fraud and dishonesty, and more.
